1. Scope and Subject Matter of the Agreement
These General Terms and Conditions (“Terms” or “T&Cs”) govern the use of the website grandeturismo.com, including any related services, applications, or features (collectively referred to as the “Platform”), and the legal relationship between Grande Turismo (“Grande Turismo”, “we”, “our”, or “us”) and the users of the Platform (“Customers”, “Users”, or “you”).
These Terms constitute a legally binding agreement between you and Grande Turismo regarding your access to and use of the Platform.
Grande Turismo operates an online marketplace that allows independent third-party organizers and service providers (“Suppliers”) to offer and sell tickets or reservations for automotive-related events, experiences, and activities (“Activities”). Such Activities may include, but are not limited to, track days, driving experiences, motorsport events, car shows, simulator experiences, guided tours, and other automotive-related experiences.
The Platform enables users to discover, compare, and book Activities provided by Suppliers. Grande Turismo acts solely as an intermediary facilitating bookings between Customers and Suppliers and does not operate or directly provide the Activities listed on the Platform unless explicitly stated otherwise.
By accessing the Platform, creating an account, or making a booking, you acknowledge that you have read, understood, and agree to be bound by these Terms.
You must be at least 18 years old, or have the consent of a parent or legal guardian, to use the Platform.
If you make a booking on behalf of other participants, you represent and warrant that you have the authority to accept these Terms on their behalf and that you have informed them of these Terms.
Grande Turismo does not guarantee the availability of any Activity listed on the Platform. All Activities are offered and managed by independent Suppliers and are subject to their availability and specific conditions.
2. Role of Grande Turismo as an Intermediary
2.1 Marketplace Model
Grande Turismo operates an online marketplace that enables independent third-party organizers and service providers (“Suppliers”) to list and offer automotive-related activities, events, and experiences (“Activities”) to users of the Platform.
Grande Turismo does not own, operate, organize, or control the Activities listed on the Platform. The Platform merely facilitates the discovery and booking of Activities offered by independent Suppliers.
When you make a booking through the Platform, the contract for the provision of the Activity is formed directly between you and the respective Supplier.
Suppliers are independent third parties and are not employees, agents, partners, or representatives of Grande Turismo.
2.2 Limitation of Responsibility
Grande Turismo is not a party to the contract between the Customer and the Supplier.
Accordingly, Grande Turismo is not responsible or liable for:
- the performance of the Activity
- the quality or safety of the Activity
- the legality, licensing, or insurance of the Activity
- compliance with applicable laws or regulations by the Supplier
Any claims or disputes relating to an Activity, including but not limited to cancellations, delays, injuries, accidents, damages, or service quality, must be addressed directly to the respective Supplier.
Grande Turismo may assist in facilitating communication between Customers and Suppliers but has no obligation to resolve disputes between them.
2.3 Accuracy of Information
All information regarding Activities listed on the Platform, including but not limited to descriptions, photographs, safety requirements, availability, and pricing, is provided and maintained by the respective Suppliers.
Grande Turismo does not verify, guarantee, or warrant the accuracy, completeness, or reliability of such information.
The inclusion of an Activity on the Platform does not constitute an endorsement, recommendation, or guarantee by Grande Turismo.
2.4 Risks Associated with Activities
Many Activities offered through the Platform involve motorsport, driving, or other automotive experiences that may carry inherent risks.
Participation in such Activities is undertaken at the Customer’s own risk.
Grande Turismo is not responsible for any accidents, injuries, damages, or losses that may occur in connection with participation in an Activity.
3. Registration and User Accounts
3.1 Account Creation
To access certain features of the Platform, including booking Activities, you may be required to create a user account.
When creating an account, you agree to provide accurate, current, and complete information and to keep such information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You must immediately notify Grande Turismo if you become aware of any unauthorized use of your account or any security breach.
Users may not create multiple accounts for the purpose of circumventing restrictions, abusing promotions, or engaging in fraudulent activity.
Grande Turismo reserves the right to suspend, restrict, or terminate user accounts at its sole discretion if it reasonably believes that a user has violated these Terms, engaged in fraudulent activity, or misused the Platform.
3.2 Age and Eligibility
The Platform is intended for individuals who are at least 18 years of age.
Minors may only use the Platform under the supervision and with the consent of a parent or legal guardian.
Specific eligibility requirements for individual Activities, including minimum age, driving license requirements, or experience levels, may be determined by the respective Supplier and must be strictly adhered to.
Suppliers reserve the right to verify the identity and age of participants prior to the Activity and may deny participation if eligibility requirements are not met.
3.3 Prohibited Use of Accounts
Users agree not to:
- create false or misleading accounts
- impersonate another person or entity
- use automated systems, bots, or scripts to access the Platform
- attempt to manipulate bookings, pricing, or availability
- engage in fraudulent or unlawful activities through the Platform
Grande Turismo reserves the right to investigate suspected violations and take appropriate action, including suspension or termination of accounts.
4. Booking Process and Conclusion of Contract
4.1 Non-Binding Listing and Booking Request
The presentation of Activities on the Platform does not constitute a legally binding offer but rather an invitation for users to submit a booking request.
By clicking the “Confirm & Pay” button (or a similarly labeled button) at the end of the checkout process, you submit a binding request to book the selected Activity.
Before submitting your booking request, you will have the opportunity to review your order details and correct any input errors.
All bookings are subject to availability and confirmation.
4.2 Booking Confirmation
A contract between the Customer and the Supplier is formed only when the booking is confirmed and payment has been successfully processed.
Following a successful booking, you will receive a booking confirmation via email, which may include a digital ticket, QR code, or voucher required to participate in the Activity.
If payment cannot be successfully processed, the booking will not be confirmed and no contract will be formed.
Grande Turismo reserves the right, together with the Supplier, to refuse or cancel booking requests in cases including but not limited to pricing errors, suspected fraud, or unavailability of the Activity.
4.3 Customer Responsibility
It is your responsibility to review the booking confirmation and ensure that all booking details are correct. Any discrepancies should be reported to customer support as soon as possible.
4.4 Arrival and Punctuality
You are responsible for arriving at the designated meeting point at the time specified in your booking confirmation.
Many motorsport and automotive Activities operate on strict schedules. If you arrive late or fail to attend the Activity, the booking may be considered redeemed and you may not be entitled to a refund or rescheduling, subject to the cancellation policy of the respective Supplier.
5. Prices, Payments, and VAT
5.1 Price Indication
Prices for Activities listed on the Platform are determined and set by the respective Suppliers.
Activities may be listed in the currency chosen by the Supplier. The Platform may display prices in different currencies based on the currency selected by the user for convenience.
Where prices are displayed in a currency different from the Supplier’s original currency, the amounts shown are based on indicative currency conversion rates available at the time of display. These converted prices are provided for informational purposes only.
During checkout, users may have the option to pay either in the currency selected for display on the Platform or in the original currency defined by the Supplier.
The final amount charged may vary slightly due to currency conversion rates, payment processor fees, or bank charges applied by the payment provider or the user’s financial institution.
Prices displayed on the Platform include applicable taxes such as Swiss VAT where required by law and any mandatory charges. Optional services or add-ons may be displayed separately during the booking process.
Prices may be modified by the Supplier at any time prior to the confirmation of a booking.
5.2 Payment Methods and Security
Payments must be made through the secure payment methods made available on the Platform, which may include credit cards, debit cards, digital wallets, or other supported payment methods.
Payments are processed through third-party payment service providers. Grande Turismo does not store full credit card information on its servers.
Grande Turismo facilitates the collection of payments on behalf of Suppliers through the Platform.
All payment transactions are encrypted and processed using industry-standard security protocols.
5.3 Platform Fees
Grande Turismo may charge service fees, booking fees, or platform fees in connection with bookings made through the Platform. Any such fees will be clearly displayed to the Customer before the booking is confirmed.
5.4 VAT and Tax Compliance
In accordance with applicable tax laws, including the 2025 revision of the Swiss VAT Act, Grande Turismo may in certain cases be required to act as a deemed supplier for VAT purposes.
Where required by law, Grande Turismo may calculate, collect, and remit applicable VAT on transactions facilitated through the Platform.
Suppliers remain responsible for:
- providing accurate tax information
- complying with their tax obligations
- issuing invoices where required
Suppliers agree to indemnify and hold Grande Turismo harmless for any liabilities arising from inaccurate or incomplete tax information provided by them.
5.5 Refund Processing
Where refunds are applicable under the cancellation policy of the Supplier or under applicable consumer protection laws, refunds will generally be processed to the original payment method used for the booking.
6. Cancellations, Modifications, and Refunds
6.1 Supplier Policies
Each Activity listed on the Platform is subject to the specific cancellation, modification, and refund policy defined by the respective Supplier. These policies are displayed on the Activity description page and form part of the contract between the Customer and the Supplier.
Once a booking has been confirmed, cancellations or modifications may only be made in accordance with the applicable Supplier policy.
Customers are responsible for reviewing the cancellation terms before completing a booking.
6.2 Customer Cancellations
If a Customer cancels a booking, the refund eligibility and conditions will be determined by the cancellation policy of the respective Supplier.
Depending on the Supplier’s policy, cancellations may result in:
- a full refund
- a partial refund
- credit for a future booking
- or no refund
Failure to attend the Activity at the scheduled time (“no-show”) may result in the booking being considered redeemed and no refund being issued.
6.3 Cancellations by the Supplier
Suppliers may cancel or reschedule Activities due to circumstances including but not limited to:
- adverse weather conditions
- safety concerns
- equipment failure
- operational issues
- force majeure events
If an Activity is cancelled by the Supplier, the Customer may be offered:
- rescheduling to an alternative date, or
- a refund of the booking price where applicable.
Grande Turismo is not responsible for any incidental or consequential costs incurred by Customers due to such cancellations, including but not limited to travel expenses, accommodation costs, or visa fees.
6.4 Refund Processing
Where a refund is applicable, it will generally be processed to the original payment method used for the booking.
Grande Turismo facilitates the refund process but is not financially responsible for refunds issued by Suppliers.
Refunds will be processed after the corresponding refund amount has been received from the Supplier.
7. Participation Requirements and Safety
7.1 Health and Physical Fitness
By booking or participating in an Activity, you confirm that you and any participants for whom you make a booking are in good health and possess the physical fitness, skills, and experience required for the Activity.
Certain Activities may involve significant physical forces, high speeds, extreme temperatures, or other demanding conditions. Participants are responsible for ensuring that they are medically and physically able to safely participate.
Participants must inform the Supplier of any relevant health conditions that may affect their ability to safely participate in the Activity, including but not limited to heart conditions, back injuries, pregnancy, or other medical concerns.
7.2 Driver’s Licenses and Eligibility
For driving Activities, participants must hold a valid and appropriate driver’s license as specified in the Activity description.
Participants must also comply with any eligibility requirements established by the Supplier, including but not limited to minimum age, driving experience, height or weight restrictions, and required safety equipment.
Failure to meet these requirements at the time of the Activity may result in denial of participation without entitlement to a refund.
7.3 Conduct and Safety Instructions
Participants must follow all safety instructions and operational rules provided by the Supplier, instructors, or track marshals.
The Supplier reserves the right to refuse or terminate participation for any individual who:
- fails to comply with safety instructions
- engages in unsafe or reckless behavior
- appears to be under the influence of alcohol or drugs
- otherwise poses a safety risk to themselves or others
In such cases, participation may be terminated without entitlement to a refund.
7.4 Inherent Risks of Activities
Many Activities offered through the Platform involve motorsport or driving experiences that carry inherent risks, including the risk of accidents, injuries, or property damage.
By participating in an Activity, you acknowledge and accept these inherent risks and agree to participate at your own responsibility.
Participants remain responsible for their own conduct during the Activity and may be held liable for damages caused by their actions where applicable.
8. Limitation of Liability
8.1 Liability of Grande Turismo
To the maximum extent permitted by applicable law, Grande Turismo shall only be liable for damages caused by its own intent or gross negligence.
Liability for slight or ordinary negligence is excluded to the fullest extent permitted by Article 100 of the Swiss Code of Obligations (SCO).
Grande Turismo shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:
- loss of profits
- loss of income
- loss of business opportunity
- loss of enjoyment
- travel or accommodation expenses.
Where liability cannot be excluded under applicable law, Grande Turismo’s maximum liability shall in any case be limited to the total amount paid by the Customer for the respective booking.
8.2 Liability for Activities and Third-Party Services
Grande Turismo acts solely as an intermediary platform facilitating bookings between Customers and independent Suppliers.
Grande Turismo does not operate, manage, supervise, or control the Activities listed on the Platform.
Accordingly, Grande Turismo assumes no liability for:
- the performance of an Activity
- the safety or quality of an Activity
- personal injury or death occurring during an Activity
- damage to personal property
- the actions or omissions of Suppliers, instructors, drivers, or other third parties involved in the Activity.
All liability relating to the execution of the Activity rests exclusively with the respective Supplier in accordance with their contractual terms and applicable law.
8.3 Platform Availability
Grande Turismo does not guarantee that the Platform will be available at all times or free from interruptions, technical errors, or system failures.
Grande Turismo shall not be liable for damages resulting from temporary unavailability of the Platform, technical malfunctions, or external disruptions beyond its control.
8.4 Assumption of Risk
Many Activities offered through the Platform involve automotive, motorsport, or adventure experiences that carry inherent risks, including the risk of serious bodily injury, permanent disability, or death.
By participating in such Activities, you acknowledge and accept these risks and voluntarily assume full responsibility for your participation.
You further acknowledge that participation in such Activities is undertaken at your own risk.
9. Insurance Requirements
The booking price for Activities offered on the Platform does not include any form of insurance, unless explicitly stated otherwise in the Activity description.
Participants are solely responsible for ensuring that they have adequate insurance coverage for their participation in the Activity. This may include, where applicable:
- health or medical insurance
- accident insurance
- personal liability insurance
- travel insurance
- motor vehicle insurance for driving Activities.
Participants should ensure that their insurance coverage is valid in the country where the Activity takes place and that it covers the specific type of Activity involved.
Certain Activities, particularly motorsport, driving experiences, or high-risk activities, may involve additional risks such as vehicle damage or third-party liability. Participants may be held financially responsible for damages caused during the Activity in accordance with the Supplier’s terms.
Suppliers may require participants to hold specific insurance coverage or to accept additional insurance terms before participation in the Activity. Participants are responsible for reviewing and complying with any such requirements.
Grande Turismo strongly recommends obtaining appropriate insurance coverage before participating in high-risk Activities. Please note that certain insurance policies, including standard Swiss accident insurance (UVG), may limit or exclude coverage for motorsport or similar high-risk activities.
10. Intellectual Property and User Content
10.1 Platform Ownership
All intellectual property rights in and to the Platform, including but not limited to text, graphics, images, logos, trademarks, software, design elements, and other materials, are owned by Grande Turismo or its licensors and are protected by applicable copyright, trademark, and intellectual property laws.
You may not copy, reproduce, distribute, modify, publish, or otherwise use any content from the Platform for commercial purposes without the prior written consent of Grande Turismo.
10.2 Organizer Content
Suppliers and event organizers who publish Activities on the Platform retain ownership of the content they upload, including event descriptions, images, and promotional materials.
By submitting such content to the Platform, Suppliers grant Grande Turismo a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute such content for the purpose of operating, promoting, and improving the Platform.
Suppliers represent and warrant that they have the necessary rights to upload such content and that it does not infringe the rights of any third party.
10.3 User Reviews, Photos, and Other User Content
By submitting reviews, photos, videos, or other content to the Platform, you grant Grande Turismo a non-exclusive, perpetual, worldwide, royalty-free, and irrevocable license to use, reproduce, modify, adapt, publish, and display such content for marketing, promotional, and operational purposes.
You represent and warrant that:
- you own or control all rights to the content you submit
- the content does not violate any third-party rights
- the content complies with applicable laws.
10.4 Content Standards and Removal
Users and Suppliers must not upload, post, or share content that:
- infringes intellectual property rights
- is defamatory, abusive, or unlawful
- contains misleading or fraudulent information.
Grande Turismo reserves the right to remove, modify, or disable access to any content that violates these Terms or that we reasonably consider inappropriate.
10.5 Platform Use Restrictions
You may not use automated systems, bots, scraping tools, or other automated methods to access, extract, or copy data from the Platform without our prior written permission.
Unauthorized use of the Platform’s content or data may result in suspension of access and legal action where appropriate.
11. Data Protection
Grande Turismo processes personal data in accordance with applicable data protection laws, including the Swiss Federal Act on Data Protection (nFADP) and, where applicable, other relevant data protection regulations.
Personal data may be collected and processed for the purpose of operating the Platform, facilitating bookings between Customers and Suppliers, providing customer support, processing payments, and improving our services.
In order to provide these services, personal data may be processed by trusted third-party service providers (such as payment processors, hosting providers, and analytics services) acting on our behalf.
Where necessary, personal data may be transferred to other countries in accordance with applicable data protection laws.
Further information about how we collect, use, store, and protect personal data is set out in our Privacy Policy, which forms an integral part of these Terms and is incorporated herein by reference.
12. Miscellaneous Provisions
12.1 Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
The invalid provision shall be replaced by a valid provision that most closely reflects the legal and economic intent of the original provision.
12.2 Amendments
Grande Turismo reserves the right to amend or update these Terms and Conditions at any time.
The version of the Terms in effect at the time of a booking shall apply to that specific transaction. Any updates to the Terms will apply to future use of the Platform.
Where changes materially affect users’ rights or obligations, Grande Turismo will notify registered users by appropriate means, such as email or platform notification.
12.3 Applicable Law and Jurisdiction
These Terms and Conditions and any disputes arising out of or in connection with them shall be governed by and construed in accordance with Swiss substantive law, excluding its conflict-of-law rules.
The exclusive place of jurisdiction shall be Zurich, Switzerland, unless mandatory consumer protection laws require another jurisdiction.
12.4 Entire Agreement
These Terms and Conditions, together with the Privacy Policy and any applicable booking terms displayed on the Platform, constitute the entire agreement between the Customer and Grande Turismo regarding the use of the Platform.
They supersede all prior agreements, communications, or understandings relating to the same subject matter.
12.5 No Waiver
Failure by Grande Turismo to enforce any provision of these Terms shall not be deemed a waiver of its right to enforce that provision or any other provision at a later time.
13. Supplier Responsibilities
13.1 Independent Suppliers
Suppliers offering Activities on the Platform act as independent third-party service providers and are solely responsible for the organization, operation, and execution of the Activities they publish.
Grande Turismo does not supervise, control, or operate the Activities listed on the Platform and assumes no responsibility for the compliance of Suppliers with applicable legal or safety obligations.
13.2 Supplier Compliance
Suppliers are responsible for ensuring that their Activities:
- comply with all applicable laws and regulations
- meet all safety, licensing, and operational requirements
- maintain appropriate insurance coverage where required
- are accurately described on the Platform, including schedules, pricing, safety requirements, and participation conditions.
Suppliers remain responsible for ensuring that all information provided on the Platform is accurate, complete, and not misleading.
13.3 Responsibility for Personnel and Equipment
Suppliers remain fully responsible for the conduct and performance of their staff, instructors, drivers, vehicles, venues, and any equipment used in connection with the Activity.
Grande Turismo shall not be responsible for any acts, omissions, or negligence of Suppliers or their personnel.
14. Force Majeure
14.1 Events Beyond Control
Grande Turismo shall not be liable for any failure or delay in the performance of its obligations where such failure or delay results from events beyond its reasonable control.
Such events may include, but are not limited to:
- natural disasters
- extreme weather conditions
- governmental actions or regulations
- strikes or labor disputes
- technical infrastructure failures
- venue closures
- public health emergencies
- other unforeseeable events that prevent the execution of an Activity.
14.2 Consequences of Force Majeure
Where an Activity cannot be performed due to a force majeure event, the Activity may be cancelled, postponed, or modified in accordance with the Supplier’s policies and applicable law.
Grande Turismo shall not be responsible for any additional costs incurred by participants as a result of such events.
15. Fraud, Abuse, and Misuse of the Platform
15.1 Prohibited Conduct
Users must not misuse the Platform or engage in activities that violate these Terms, applicable laws, or the legitimate interests of the Platform.
Prohibited conduct includes, but is not limited to:
- fraudulent bookings or payment abuse
- unauthorized resale of tickets or bookings
- manipulation of reviews, ratings, or feedback systems
- use of automated systems, bots, or scraping tools to access or extract data from the Platform
- interference with the operation, security, or integrity of the Platform.
15.2 Enforcement Measures
Grande Turismo reserves the right to suspend or terminate user accounts, cancel bookings, or restrict access to the Platform where misuse of the Platform is reasonably suspected.
Grande Turismo may also refuse service or take appropriate legal action where necessary to protect the integrity and security of the Platform.
